The State Board of Health is empowered to make all necessary and reasonable rules and regulations of a general nature for the protection of the public health and safety; for the general amelioration of the sanitary and hygienic conditions within the state; for the suppression and
prevention of infectious, contagious, and communicable
diseases; for the proper enforcement of quarantine, isolation,
and control of such diseases; and for the proper control of
chemical exposures that may result in adverse health effects to
the public.  The Department of Health is the state agency responsible for implementing the Board's regulations.

This site was developed to provide easy access to all State Board of Health rules and other pertinent legal documents.

NOTICES OF PUBLIC HEARINGS

The Arkansas Department of Health will hold three (3) public hearings on January 29, 2009, in Room #2508 of the Department of Health building at 4815 West Markham, Little Rock, Arkansas, to allow interested persons to comment on the proposed adoption of the following rules and regulations.

New Regulations pertaining to Health Facility Infection Disclosure pursuant to Act 845 of 2007

Public Hearing:           9:00 a.m., January 29, 2009

Copies of the proposed Rules and Regulations will be available for public inspection and copying at the Center for Health Protection, 2nd Floor North, at the Department of Health.

The public may submit written comments no later than 8:00 a.m. on January 29 to James Phillips, M.D., Chief, Infectious Disease Branch, Arkansas Department of Health, 4815 West Markham Street, Slot #42, Little Rock, Arkansas 72205.

Amended Regulations pertaining to the Control of Communicable Diseases – Tuberculosis pursuant to Act 313 of 2007

Public Hearing:           10:00 a.m., January 29, 2009

Copies of the proposed Rules and Regulations will be available for public inspection and copying at the Tuberculosis Section, 4th Floor South, at the Department of Health.

The public may submit written comments no later than 8:00 a.m. on January 29 to Iram Bakhtawar, M.D., Chief, Tuberculosis Section, Arkansas Department of Health, 4815 West Markham Street, Slot #45, Little Rock, Arkansas 72205.

Amended Regulations pertaining to Immunization Requirements

Public Hearing:           11:00 a.m., January 29, 2009

Copies of the proposed Rules and Regulations will be available for public inspection and copying at the Immunization Section, 2nd Floor South, at the Department of Health.

The public may submit written comments no later than 8:00 a.m. on January 29 to Karen Fowler, Chief, Immunization Section, Arkansas Department of Health, 4815 West Markham Street, Slot #48, Little Rock, Arkansas 72205.

 

Rules and Regulations Currently Being Amended,
Repealed or Promulgated

The Board updates its regulations on a continuing basis.  The Board must follow the Administrative Procedure Act ("APA") to amend, repeal or adopt  a regulation.  An essential part of the APA allows the public to comment on any regulation being amended, repealed or proposed and the Board values your comments and questions.  If you are interested in a summary of the APA, please utilize the link provided below.

New Rules
 

The Board, at its regularly scheduled meeting held on April 24, 2008, voted to approve new rules after the passage of the Arkansas Orthotics, Prosthetics and Pedorthics Practice Act of 2007.  The rules have been signed by Governor Beebe and will become effective on June 1, 2008.  The enabling legislation is codified at Ark. Code Ann. §§ 17-107-101- 311.  You may find the rules at the link provided below.

Proposed Amendments to Existing Rules

The Board, at its regularly scheduled meeting held on April 24, 2008, voted to approve amendments to the Rules and Regulations For Critical Access Hospitals.  The rules have been signed by Governor Beebe and will become effective on June 1, 2008.  You may find the rules at the link provided below.

The Board, at its regularly scheduled meeting held on January 24, 2008, voted to amend its Rules and Regulations For Control of Sources of Ionizing Radiation.  You may view the draft rules at the link provided below.
